PredictableEDU LLC values you and your right to privacy.  This privacy policy is designed to create transparency about the information we collect.

This Website Privacy Policy regulates the collection, use and disclosure of information collected on the website located at www.PredictableEDU.com. By using this website, you agree to the terms of this Privacy Policy. If you do not agree to these terms, you are prohibited from using this website and should exit immediately. You acknowledge that the Privacy Policy is subject to modification and that your continued use of the site constitutes agreement with the then-current terms of the Privacy Policy. The date of the most recent update can be found at the top of this document.

Who we are

PredictableEDU, LLC collects information to better serve our clients and visitors. When we have a better picture of how people are using our website, we can improve the experience of our users.

The information we gather depends on the portion of the website being visited. For password protected areas, we capture information including the username and the date, time, and/or length of the visit. In other areas, we record information that you affirmatively provide to us. For example, you may choose to provide us with contact information including your name and email address.  We use this information to contact you about our products and services including sending newsletters and other marketing materials. If you purchase products or services through the website, you will be asked to provide credit card information used to bill you for such products or services.

For general visitors to our websites, we use “cookies” and other tools to collect information about users’ visits, such as which pages of the site are visited and for how long. Although some of the information collected may be linked to a specific IP address, we do not try to identify the person(s) using that IP address except for the very limited circumstances described herein.  This website uses Google Analytics.  If you wish to know more about the data Google Analytics collects, visit this link: https://policies.google.com/technologies/partner-sites

Your information may be accessible by the vendors used to provide technical support or “plug-ins” for this website.  www.PredictableEDU.com operates on a WPEngine [wordpress engine] platform.  Except as described herein, PredictableEDU, LLC does not sell or share your information with any third parties.

What personal data we collect and why we collect it

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Help Desk

If you have questions about courses on PredictableEDU, we have provided a ticket system to enter your request, question or comment.  The tool we use for this is called HelpScout.  In order to reply to your request, we ask [optionally] for your first name.  We also ask for your e-mail address [required field] so we can reply back to you.  We also collect you level of skill to better associate how to answer your question for optimum understanding.

The question or help request you submit is forwarded to a Gmail address called helpatpredictableedu@gmail.com.  Please review Gmail’s privacy statement for how they protect your data.  When the request is received through Gmail, we automatically forward that e-mail to our HelpScout mailbox for processing.  Please review HelpScout’s privacy statement , Security Statement and for our EU friends, the HelpScout’s GDPR statement for more information on how they protect your data as well.

On HelpScout, we store your e-mail address & the conversation thread as well as the initial information we collect from the help form on this website.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Contact forms

To register for classes, both free and complimentary, or if you want executives from PredictableEDU, LLC to contact you, we request you fill in a contact form.  Our contact forms run under the Gravity Forms plugin.

PredictableEDU Learning Management System (LMS) application (LearnDash LMS) for courses, course progression, lessons & quiz performance

When you signed up for courses on PredictableEDU, we collected information from you upon signup.

For paid courses, we collect additional information about you during the course purchase process (Stripe is our payment gateway for collecting credit card or Paypal information), as well as information relating to your course progression and quiz performance.

What we collect and store on LearnDash

When you purchase from us, we’ll ask you to provide email address. We’ll use this information for purposes, such as, to:

–Send you information about your account and order

–Create your account for our LMS

If you register a free PredictableEDU account then we will store your email address and name.

We store information about you for as long as your account exists.

We store course progress, including completion status, quiz scores, assignments and/or essay submissions (if applicable).

We will also store comments on courses, lessons, topics, assignments, and essays if you choose to leave them.

Who on our team has access to LearnDash data

Members of our team have access to the information you provide us. For example, both Administrators and Group Leaders can access:

–Order information such as your enrolled courses, course progress and username / email address.

Any additional information added in your WordPress User Profile can also be visible to the administrator(s).

What LearnDash data we share with others

You have the option of opting-in to our marketing automation software called Aweber.  This allows us to send you information for:

  • upcoming courses
  • enhancements to existing courses
  • events we may hold in a city near you
  • new books Marylou Tyler has written
  • other educational information we think may be of interest to you

In addition, we store your member information in a plugin called MemberPress.  Please see Member Press’ Privacy Policy for more details.

PredictableEDU Course Payments

We use one third party payment processor to take payments on PredictableEDU.  The name of the payment processor is Stripe.

We accept payments through Stripe. When processing payments, some of your data will be passed to Stripe, including information required to process or support the payment, such as the purchase total and billing information.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

Who we share your data with

If you want to be able to receive information from PredictableEDU, LLC you may provide your name and contact information to us through the website. By doing so, you consent to receive communications from PredictableEDU, LLC. We will not sell or rent your information to other marketers. Your personal information would only be disclosed to a third party (other than as described herein) upon a merger or reorganization between us and such a third party or as needed to provide technical support or development for the website.

Our websites will occasionally have links to other websites that are not operated by PredictableEDU, LLC. We are not responsible for the contents of those websites and have no control over what information they may or may not collect from you.

We respect your privacy, but we cannot guarantee that your information will never be disclosed in a manner inconsistent with this Privacy Policy. You hereby release us from any and all claims related to the use of intercepted information or information which is obtained in an unauthorized manner. Please note that PredictableEDU, LLC cannot be responsible for the actions of third parties who may attempt to capture your information when you transmit it to us.

We may disclose your personal information when required to do so by a government agency or a court of law, or when relevant to bringing or defending a legal claim. We may also disclose the information to prevent fraud or enforce the terms of your contracts with PredictableEDU, LLC including our Terms of Use (incorporated herein by reference). We do not knowingly collect any personal information from visitors under the age of 13. We also ask that if you are under 18 years of age, you have been given permission by a parent or guardian to access the website. This website is designed for use by adults residing in the United States If you are a parent and you discover that your child under the age of 13 provided personal information to us, please let us know and we will delete that information from our files.

We may transfer your personal information to our service providers and others located in the United States or elsewhere in the world for the purposes described in this Privacy Policy. Different countries have different privacy laws and requirements, and some, including the United States, provide less legal protection for your personal information than others. Please know, however, that no matter where your personal information is collected, used, transferred or stored, if it was collected through our websites, it will be governed by and used in accordance with the terms of this Privacy Policy.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Where we send your data

Visitor comments may be checked through an automated spam detection service.

Your e-mail and first name are collected and scored in a marketing automation software called Aweber.  Their policy statement discusses at length how your information is stored and protected.  When you opt-in to PredictableEDU.com, we ask you to double-respond to our request to put your information on a list to inform you of course updates or additions, for both complimentary and paid-for courses.

If you schedule an appointment for office hours or online conference, your e-mail address and name is left on my automated calendar service – calendly.com.  Their GDPR compliance is listed here.

Additional information

This Privacy Policy and any disputes related thereto shall be governed by the laws of the State of Iowa and you consent to the state and federal courts of Polk County, Iowa as the exclusive venues for resolving any conflicts related to this Privacy Policy, without regard to Iowa’s choice of law provisions. You agree that any damages resulting from any breach of this Privacy Policy shall be limited to the total value of all products  and services you have purchased via our website.
